But most importantly, what does is portend for devolution and national integration.

With effect from last year, the Industrial Court of Kenya has since been renamed to Employment and Labour Relations Court of Kenya (ELRC) The name change is welcome as it represents the full spectrum of the Court's mandate. The court not only intervenes in an employer-employee relationship, but it also intervenes between Trade Unions and employers or employers organisations.

Employers have been complaining that the Industrial Court is quite harsh towards them. Some have argued that the industrial court is highly skewed in favour of employees. The proponents of this view argue that the court is a pro-employee court and employers stand no chance to win a suit in the court.
